Fifty million Americans belong to health clubs. In recent years there has been a 35% increase in gym injuries, according to a study by the University of Arkansas. Lawyers.com Editor-in-Chief Larry Bodine provides today's Newsbreak with some practical advice, in case you end up getting injured, while getting fit. The Consumer Products Safety Commission reports gym-related injuries send approximately 1,500 people to emergency rooms each year. If you're hurt at a health club, you'll have to overcome the assumption of risk and wavier that's part of every gym membership. These forms say you freely release the club of responsibility for any injury, disability or death. At a Cardinal Fitness Center in Indianapolis, Indiana, a man hurt his back when the seat gave way on the bicep curl machine. He sued the club, saying the machine was not maintained in a safe condition. He lost his case because of the waiver and release he signed. However, a judge struck down the waiver used by a New York Sports Club in Livingston, New Jersey. A man sued the club for his injuries sustained when the sauna he was in exploded into flames. A court may strike down the waiver and release in two situations: The health club failed to make reasonable inspection of its property and to fix any reasonably discoverable defects. The waiver and release damages the public interest in gym safety. Fitness clubs did not become a $21 billion industry by paying out settlements. So, if you are injured at the gym, Larry suggests you find a lawyer who knows how to hold a health club liable for its own negligence.
