Lawyers.com reporter Lisa Reilly looks at a high profile miscarriage of justice, through a screening of Ken Burns' documentary, "The Central Park Five." A conference at Suffolk University Law School addressed forced confessions, showcased by the film. Today marks the 24th anniversary of when a young, white woman, later known as the Central Park Jogger, was violently raped and beaten unconscious, while going for a run in New York City. The city was on edge, with the news media fueling fear and outrage, and a race to justice. Police rounded up five boys, ranging in ages from 14 to 17. Four were black. One was Hispanic. The media depicted them as a roving pack of animals, going on "wildings," brutally attacking people for pleasure. Police interrogated the suspects, with 15 to 20 hours of questioning, manipulating them with lies. Without the presence of lawyers, all five teens gave false confessions. Within weeks the defendants tried to withdraw their statements as coerced and untrue. None of their stories matched each others' nor the physical evidence. None of the DNA evidence connected them to the crime. However, in 1990, based on their confessions, a jury convicted all five defendants. In 2002, a convicted murderer and rapist, Matias Reyes, confessed to the crime. His DNA matched the crime scene. The Central Park Five convictions were vacated and they were freed. But this was after they had already served seven to 13 years in prison. In 2003, the defendants filed a lawsuit against New York City police and prosecutors. A decade later, it remains unresolved. Two of the defendants describe to Lawyers.com why they gave false confessions. Raymond Santana explains how meaningless the Miranda warnings and a right to an attorney are to a 14-year-old. "You're thinking for what? I didn't do anything wrong, so I don't need a lawyers." Studies indicate that adolescents, the intellectually disabled and mentally ill are the most vulnerable to giving false confessions. They often cave under police tactics of long interrogations and presentation of false evidence. Ken Burns daughter, co-director Sarah Burns, says she hopes the documentary can prevent forced confessions in the future. It serves as a solid reminder, especially following high profile tragedies, to avoid compounding heartbreaking losses with the loss of justice.

Hernia patients have filed lawsuits against the manufacturers of AlloDerm, a product made from the skin tissue of cadavers. They claim once implanted, the AlloDerm stretches and fails, resulting in serious and painful abdominal injuries, often requiring additional surgery. A hernia is a painful condition that occurs when an organ or tissue bulges through a weak spot in muscle of the structure that contains it. Often it's an intestine that protrudes through the stomach wall. Hemera/ Thinkstock Surgeons will patch up the hole in reconstruction surgeries. More than 20 million hernia repair surgeries are performed worldwide each year, according to NYU Langone Medical Center. Hundreds of thousands of patients have had surgery using medical patches of AlloDerm, which is manufactured by LifeCell Corporation. Lawyers.com Editorial Director Betsy Kim interviews Sol Weiss, a shareholder in Anapol Schwartz, the lead law firm representing plaintiffs in the approximately 300 cases against LifeCell. The company, which has its principle place of business in Branchburg, New Jersey, did not respond to Lawyers.com's inquiries, at the time of publication of this article. The LifeCell website currently advertises AlloDerm as offering a range of benefits to surgeons and their patients for hernia repair. In this news video, Sol describes the problem with AlloDerm and the effort to take it off the market. The plaintiffs' and defense attorneys are selecting test cases to take to trial in Superior Court of Middlesex County, New Jersey. This will assess the value of the cases to help determine resolution for patients with similar medical problems.

Illinois is the only state with a total ban on allowing gun owners to carry their weapons in public. But a federal court recently threw out this law as going too far, and violating the Second Amendment. Now, the Illinois legislature has a looming deadline to pass a concealed carry weapon statute that's less restrictive. With the strong emotional differences in the fight over guns, state lawmaking has become a house divided. Lawyers.com supervising producer John McCarthy's presents the views of multiple people critical to the debate, including Illinois Lieutenant Governor Sheila Simon. The daughter of Illinois Senator Paul Simon says the opinions on gun laws in Illinois are so polarized that she organized a firearms working group to help get the statute drafted. She sees how people feel about gun ownership frequently reflects differences in rural and urban lifestyles and concerns. NRA spokesman Todd Vandermyde emphasizes the right to own a firearm is a fundamental constitutional right, not a privilege to be meted out by bureaucrats. Illinois State Representative Chris Welch, a task force member, says he respects the Second Amendment but the law must balance this with public safety. Limitations on concealed carry weapon permits involve the following: •Defining who qualifies for a permit •Screening out people with mental issues •Identifying where permit holders can and cannot carry concealed guns •Requiring training Chicago Chief of Police Garry McCarthy says no compelling evidence shows that more guns increase public safety. However, not everyone agrees with the city's top cop. And this division may require more than just doing the math.

From the Lawyers.com newsroom, Editor-in-Chief Larry Bodine explains how a D.C. appellate court is jeopardizing workplace rights. In Noel Canning v. NLRB, the U.S. Court of Appeals for the D.C. Circuit held that President Obama's three recess appointments to the National Labor Relations Board were unconstitutional. The court vacated an unfair labor practice ruling, on the grounds that the NLRB lacked a legitimate quorum when it issued its decision. The National Labor Relations Board protects worker's rights. As one example, the agency has ruled that employees are permitted to discuss workplace issues on social media without the risk of being fired. But now, all the decisions by the NLRB made during the last year are in doubt. President Obama had the power to make NLRB appointments while the Senate was in recess for 20 days. However, Larry explains how a Republican senator used a parliamentary trick to create a technicality or legal fiction of the Senate still in session. The highly politicized D.C. court nullified the president's appointments, potentially wreaking havoc in the legal system and governmental services. This case would invalidate the NLRB's pro-employee and pro-union decisions since January 2012. If this court's decision were uniformly applied, a Congressional Research Service Report found 329 recess appointments since the start of the Reagan administration would have been invalid. Kristian Rasmussen accuses the world's largest provider of dialysis products and services of knowingly endangering dialysis patients' lives. A partner at Cory Watson Crowder & DeGaris in Birmingham, Ala., Kristian filed the first products liability cases in the country against the German company, Fresenius, over GranuFlo and NaturaLyte. Fresenius manufactures these products, used to clean and filter blood of people whose kidneys have failed. Kristian asserts GranuFlo and NaturaLyte increase the risks of atrial fibrillation (irregular heartbeats), heart attacks and cardiac deaths, during or soon after dialysis. Fresenius received multiple reports of dialysis patients suffering from heart problems and even dying, so conducted its own internal studies and found patients six to eight times more likely to experience a serious adverse cardiac events says Kristian. With GranuFlo and NaturaLyte, the body creates bicarbonate to neutralize acid buildup in the blood of dialysis patients. These products increase bicarbonate levels in patients at a faster rate than other dialysis treatments. Bicarbonate overdose can lead to heart attack, cardiac arrest and sudden death. iStockphoto/ Thinkstock Kent Jarrell, spokesperson for Fresenius, provided a written statement to Lawyers.com: "Fresenius Madical Care's actions related to its GranufFlo and NaturaLyte dialysate products were appropriate and consistent with the company's commitment to patient safety. GranuFlo and NaturaLyte are safe and effective when used in accordance with their label and instructions for use. Both products are essential to dialysis, a life support treatment for patients who have chronic kidney disease and end stage renal disease." Fresenius says that in the preliminary analysis, no conclusion was made that GranuFlo or NaturaLyte caused cardiopulmonary arrest (CPA) in the patients. "Our subsequent reviews of specific patients suggest that other factors unique to each patient caused the CPA. Dialysis patients with advanced and permanent kidney failure often have other serious illnesses, including heart or lung disease." Both plaintiffs' lawyers and the defendant refer to a Nov. 4, 2011 Fresenius internal memo. It analyzes the data of 941 hemodialysis patients who suffered CPA in 667 Fresenius facilities in 2010. The memo indicates alkalosis (excessive alkali in the blood) is a significant risk associated with CPA. It notes a progressive shift toward higher pre-dialysis bicarbonate levels, implying more patients have alkalosis prior to dialysis but an even higher percentage have alkalosis, post-dialysis. The memo says, "Borderline elevated pre-dialysis bicarbonate levels and overt alkalosis are significantly associated with 6 to 8 fold greater risk of CP arrests and sudden cardiac deaths in the dialysis facility." Kristian ties these increased risks to GranuFlo and NaturaLyte, and says the company failed to warn doctors and patients outside of their clinics. Fresenius says it communicated in memos to its clinics the benefits of individualized, patient-specific decisions concerning prescriptions. The memos also provided reminders of the potential role that its dialysates including GranuFlo and NaturaLyte can play in allowing doctors to achieve targeted bicarbonate levels in patients. The spokesman noted that the FDA required label changes for GranuFlo and NaturaLyte but has not suggested any change in formulation nor asked that clinics return the products to Fresenius. Kristian says Fresenius has attempted to delay and evade the truth. He wants his clients to receive compensation for their losses and Fresenius to be held accountable for patients' injuries and deaths. Kristian has filed the lead petition requesting consolidation of all the GranuFlo and NaturaLyte lawsuits in the country before a federal judge in Mississippi.
